I set the cpu speed back to default after reading somewhere that might be the problem but it still freezes when placed under graphics stress. The graphics card is not overclocked, it runs fast enough by default.

I can't run the experience index test without the system freezing hard during the aero testing phase, usually when it gets to textures but sometimes before, it never goes all the way through the aero testing phase of that test unless the ati driver is disabled in device manager and reduced to vga mode. Then the test will complete will give no rating, just a message that system can't be rated for some reason(i can't remember what). I think it is a driver problem, I may be wrong. I'm hoping someone else has some ideas. I receive the same error with dual ATI 4850 with Crossfire, on a Vista 64bit install. Oddly enough, it only seems to happen playing Crysis Warhead. Game works ok for awhile, then at some point, after or during loading of a saved game, the system acts flakey (strobing, stuttering, jerky), and finally craps out with this error.
After that, only a re-install of the game will help, and even that for only a short time. I contacted EA about it, no help. Globally I'd say, all the tuning done for XP is NOT TO BE USED with 7. 7 doesn't like overclocked machines* during install, and at least in my case not even afterwards. Sandu Ciorba Ciurarita. Zeus76: IMO Thats the issue with faulty drivers. Pit Games Magazine on this page. Lucky you that you managed to find drivers for your AGP card, wich ATI (or AMD) hardly support. I can't find the working drivers for WIN7 for my Sapphire HD 3850 AGP till now. This issue is quite good described on the ATI forum.
So what was the solution? I've got a Sapphire ATI HD 3850 512MB (AGP) as well.my CPU is not overclocked (3.0GHz Prescott Pentium IV), and my aperture size is set to 64MB currently (no real change relative to 128MB since the lock-ups still occur frequently). All fast-writing is disabled as well, just to be on the safe side. I've tried manually installing the Win 7 ATI drivers (v. 9.5), as well as an attempt at installing the AGP hotfix for 9.5 offered for Vista (shot in the dark), but to no avail--I still get lock-ups. For the sake of discussion, I am running Windows 7 32-bit. @grekuwawa: you wrote that you couldn't find the working drivers for your card 'till now'.if you have found them, where are they?
I've searched and searched google and various windows 7-related forums and found nothing that works. I've got no idea what I can do to remedy this situation besides overhauling my entire system, which isn't an option in the near future at all due to budget constraints right now, and certainly not for a beta test. Is my only option to snub Windows 7 due to poor backwards-compatibility and roll back to Windows XP where everything worked fine? After all, I'd just like to be able to do *anything* on the computer (including looking at msn.com) without the computer freezing up and forcing me to restart. Sure they install.but they don't fix the problem.
My computer still locks up when I try to do the performance test, specifically when it begins to run through Aero and any Direct 3D functions (at the beginning of the test, essentially). I've tried installing the hotfix driver package available through game.amd.com straight, in vista compatibility mode, hard-install through Device Manager, and each results in the same end.lockups with a little message on reboot/log-in welcoming me with a summary of a blue screen error. It's also convenient that when I wait the few moments for windows to find a solution over the net, the dialogue box disappears and that's the last I see of it.until the next lock-up and reboot. It's a shot in the dark because it's not geared specifically towards Windows 7 RC, and it is technically geared towards Vista (this is pretty obvious.I think it's redundant to even point it out).so I wasn't really counting on the 9.5 AGP hotfix that's available via ATI for Vista to magically solve the problem (though I will say hope springs eternal.). I've given up on resolving this issue. I have since installed the release candidate version 7100 and have the same issues, although the freezes occur slightly less often(still can't run system assessment). Anyways, my rig runs most modern games just fine in XP, so I'll prolly postpone a rebuild for a year or two until Win 7 is finalized and more compatible.
